Formal Forensic Opinion Evidence

Overview

 

Expert Reports are distinct from Litigation Support.

 

Where formally retained, independent forensic reports are prepared for use in court or arbitration proceedings. 

These reports provide structured behavioral analysis based on documented materials and, where applicable, additional data sources. 

Case-Specific Forensic Reports

 

A formal expert report may be warranted where: 

  • Longitudinal behavioral patterns require structured documentation

  • The distinction between coercive control and other conflict dynamics is contested

  • Continuity between pre- and post-separation conduct requires integrated analysis

  • Escalation patterns and potential child impact require formal assessment

  • Independent expert opinion evidence is necessary for the trier of fact

 

Reports analyze whether documented conduct reflects a longitudinal pattern of coercive and controlling behavior and the behavioral implications of that pattern.

This role does not include credibility assessments, factual findings or acting as trier of fact. The work is limited to behavioral analysis of documented materials within the scope of the retainer.

Subject Matter Expert Reports and Testimony

 

In some matters, counsel may require a Subject Matter Expert to educate the Court regarding the science of coercive control.

This role is distinct from ca case-specific behavioral analysis. 

 

Subject Matter Expert testimony may address:

  • The definition and features of coercive control

  • Distinctions between episodic conflict and coercive control

  • Post-separation abuse dynamics

  • Relevant social science research

  • Common misinterpretations of coercive control and misconceptions regarding how parties may present in coercive control litigation.  

 

Subject Matter Expert opinions are educational in nature and do not assess the credibility of specific parties or determine factual findings. 

The role of subject matter expert does not include reviewing of case-specific materials or access to detailed facts, unless separately retained to do so. 

 

Duty to the Court

In all formal expert engagements, the duty is to the Court. Independent opinion evidence is provided within the scope of expertise. Opinions are impartial, evidence-based, and not advocacy driven. 

 

Methodology 

Reports are prepared using a transparent and replicable forensic methodology grounded in current research and professional standards. 

The methodology typically includes:

  • Structured document review

  • Pattern coding and longitudinal behavioral pattern analysis

  • Thematic synthesis

  • Application of behavioral science principles to documented conduct.

 

All conclusions are based solely on reviewed materials and are limited to the scope of the retainer. 

 

Scope and Limitations

Expert reports:

  • Do not determine legal outcomes

  • Do not provide legal advice

  • Do not make parenting or custody recommendations

  • Do not provide psychological testing or parenting capacity assessments. 

 

The role of the expert is to provide independent behavioral analysis within the defined parameters of the engagement. 

 

Testimony ​

Where required, I may provide testimony regarding:

  • Behavioral pattern analysis

  • Methodology

  • Application of social science research to documented conduct

 

All testimony is confined to the scope of the report and expert retainer. 

 

Professional Standards

All expert work is:

  • Independent

  • Evidence-Based

  • Methodologically transparent

  • Grounded in current social science research

  • Limited to the defined scope of engagement.

Alignment with Alberta’s FFP Proportionate Case Management

 

In Alberta, where the Family Focused Protocol (FFP) emphasizes early engagement, case triage, and proportional process selection, formal expert evidence may assist the Court in understanding complex behavioral dynamics in matters involving allegations of coercive control or family violence. 

Structured expert analysis may clarify whether documented conduct reflects a persistent pattern of coercive and controlling behavior and the behavioral implications of that pattern.   

Who This Service is Not For

 

Expert report services are not intended for:

  • Advocacy or partisan opinion

  • Psychological testing or clinical treatment

  • Parenting capacity assessments

  • Situations lacking sufficient documentary material

  • Engagements seeking legal advice or strategic direction

**Disclaimer: Independence and Dual Role Policy

If an independent expert opinion may be required in a matter, counsel should consider retaining FCCS for expert services from the outset. Prior involvement in litigation support may preclude FCCS from later acting as an expert in the same case.

 

Forensic Coercive Control Solutions Inc. (FCCS) and Trish Guise maintain strict professional role separation in accordance with forensic practice standards. FCCS or Trish Guise will not provide expert opinions in matters where they have previously provided intervention services, litigation support, coaching, consultation, or any other professional service to any party within the same family system.

 

Once FCCS establishes a professional service relationship in a non-expert capacity, it will not subsequently act as an expert witness in that matter. This policy is intended to preserve independence, avoid dual roles, and maintain the integrity of the expert opinion process
